Terms and Conditions
	To be an authorized affiliate of the PhottixStore.com, you agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before registering and using the PhottixStore.com service as an affiliate. By signing up for the PhottixStore.com affiliate program, you indicate your acceptance of this agreement and its terms and conditions. Phottix Affiliate Program Agreement This an agreement which explains the Phottix Affiliate Program’s terms and conditions. By completing and submitting the online application, you acknowledge that you have read, understand and agree to be bound by this agreement. This agreement is a legally binding. Only those parties that lawfully can enter into contracts under applicable law can participate in this program. Enrollment Your application to the Phottix Affiliate Program will be assessed and you will be notified if you are accepted or rejected. It is the sole discretion of Phottix as to which sites are accepted or rejected. Unacceptable sites include: “adult” or sexually explicit sites, sites that promote violence, any form of discrimination, relate to illegal activities. “Scraper” or Spam sites will little or no original content, or site that publish copyright material without permission are also unacceptable. Any sites that use the name Phottix or its products, or variations thereof in the domain name or HTML code include page titles, tags, will not be accepted. If rejected, you may reapply. If your site is deemed unacceptable at some point in the future Phottix reserves the right to terminate this agreement without notice. Phottix, or its agents, may monitor your site and its content to maintain the quality and integrity of this program. Nature of Relationship You and Phottix are independent contractors. This Agreement in no way creates any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Phottix. Graphics The Phottix Affiliate Program will provide you with graphics and text links to use as part of this agreement. You agree to only use materials provided by Phottix in an unedited form. You also agree that the ownership of these graphics and associated materials remains with Phottix, and you have no rights to the provide materials. Orders Phottix will pay five per cent (5 %) of total sales at phottixstore.com coming from your website. When the total commissions due to you exceed fifteen dollars USD ($15.00 USD) at the end of any calendar month, Phottix will send a payment by PayPal for the applicable commissions. Such payments will be made approximately fifteen (15) days after the end of any calendar month in which accumulated earned commissions exceed fifteen dollars USD ($15.00 USD). If at the end of any calendar month earned commissions are less than fifteen dollars USD ($15.00 USD), such earned commissions will be carried over to the following month and disbursed once they exceed fifteen dollars USD ($15.00 USD). If your participation in the Phottix Affiliate Program is terminated and your commissions are less than fifteen dollars USD ($15.00 USD), such commissions shall be forfeited. Sales are considered direct sales. Phottix will be solely responsible for processing orders and customer service. Commissions will not be paid on canceled orders or returned items. Phottix reserves the right to reduce your total commission in the event of a canceled order or returned product. Phottix also reserves the right to cancel commissions on items purchased through your affiliate link for your own personal use. Website Maintenance Phottix is not responsible for the development, operation, and maintenance of your website. Phottix is not responsible for the content of your website or any third-party copyright or trademark issues. Phottix disclaims all liability in these matters. Legal Compliance You agree that while you are a member of the Phottix Affiliate Program your website and/or email marketing campaigns will adhere to and obey any laws, regulations, or rules, put in place by government or regulatory agencies that have jurisdiction over your city, state, province or nation. You agree to update your site to reflect any future legislative or regulatory changes. Terms You may cancel this agreement and your participation in the Phottix Affiliate Program, with or without cause, at any time by notifying the program administrator. Upon terminating this agreement you will remove any graphics, links, or promotional materials provided by Phottix from your site. Any commissions earned after your cancellation of this program will be forfeited. Modifications The terms and conditions relating to this agreement may be changed by Phottix. If you deem any future changes unacceptable you may terminate this agreement. Continued enrollment in the program is your acceptance of any such changes. Limitation on Liability Phottix is not liable for any loss of revenue, profits, or data in connection with this Agreement. Phottix is not liable for indirect, special, punitive or consequential damages in connection with the Phottix Affiliate Program. The Laws Governing this Agreement This Agreement will be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. Warranties Phottix does not guarantee the error-free or uninterrupted service of this program or Phottix-related websites, and will not be liable for any interruptions or errors. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ITS TERMS AND CONDITIONS.
